1. Services & Agreement

These Terms of Service (“Terms”) govern your use of automation services (“Services”) provided by Thriving Automations LLC (“we,” “us,” or “our”).

By purchasing or using our Services, you agree to be bound by these Terms.

Our Services Include:

  • AI chatbot and voice agent setup
  • Lead capture automation
  • Appointment booking automation
  • Review generation systems
  • CRM configuration and training
  • Website setup (if needed)

Service Plans:

Essential Plan – $247/month:

  • AI chatbot (website, SMS, email)
  • Lead capture & instant follow-up
  • Smart appointment booking
  • Automated reminders & confirmations
  • Review generation automation
  • CRM setup & training
  • Free landing page (if needed)
  • Email support (48-hour response)

Complete Plan – $397/month:

  • Everything in Essential, plus:
  • AI voice agent (24/7 call answering & booking)
  • Advanced lead nurture campaigns
  • No-show reduction automation
  • 2-way SMS conversation management
  • Priority email support (24-hour response)
  • Quarterly optimization review

Setup Timeline: Most automation systems are completed within 7-10 business days. Timeline may vary based on complexity and client responsiveness.

2. Pricing & Payment

Contract Terms:

  • 3-month minimum commitment required
  • After 3 months, service continues month-to-month
  • 30 days’ written notice required for cancellation
  • Early termination before 3-month minimum requires payment of remaining balance

Payment Terms:

  • Monthly fees are billed automatically on the same day each month
  • First payment is due upon service agreement
  • Payments are non-refundable except as stated in Section 4

Accepted Payment Methods:

  • Credit cards (Visa, Mastercard, American Express, Discover)
  • ACH/bank transfer (by arrangement)

Late Payment:

  • Services may be suspended if payment is 10 days past due
  • A $25 late fee may be applied to overdue accounts
  • You remain responsible for all fees during suspension

Price Changes:

  • We reserve the right to modify pricing with 30 days’ notice
  • Existing clients will be grandfathered at current pricing for 90 days
  • Continued use after price change constitutes acceptance

3. Your Responsibilities

To receive Services, you agree to:

Provide Required Information:

  • Business details, services, pricing, FAQs
  • Branding materials (logo, colors, fonts)
  • Access to existing website or hosting (if applicable)
  • Timely responses to questions during setup

Maintain Active Accounts:

  • Keep payment method current
  • Respond to service-related communications
  • Notify us of any issues or needed changes

Use Services Appropriately:

  • Comply with all applicable laws
  • Not use Services for spam, fraud, or illegal activities
  • Not resell or redistribute our Services
  • You are responsible for accuracy of business information provided
  • You own all content you provide (service descriptions, images, etc.)

4. Cancellation & Refunds

Client Cancellation:

  • You may cancel after the 3-month minimum commitment
  • Provide 30 days’ written notice to support@thrivingautomations.com
  • You remain responsible for payment through the notice period

Our Right to Terminate: We may terminate Services immediately if you:

  • Breach these Terms
  • Fail to pay after 30 days
  • Use Services for illegal or fraudulent purposes
  • Engage in abusive behavior toward our team

Refund Policy:

  • Monthly fees are non-refundable
  • No refunds for partial months of service
  • If we fail to deliver Services as agreed within 30 days of payment, you may request a refund for that month

Upon Termination:

  • Your access to automation systems will be deactivated
  • We will provide a 7-day window to export your data
  • We are not responsible for data loss after termination

5. Legal Terms

Service Availability & Disclaimers:

  • We strive for 99% uptime but do not guarantee uninterrupted service
  • We are not liable for downtime caused by third-party services (GoHighLevel, hosting providers, etc.)
  • We provide automation tools and setup, not guaranteed business results
  • We make no guarantees about specific outcomes, lead volume, conversion rates, or ROI

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • Our total liability for any claim is limited to the amount you paid in the 3 months prior to the claim
  • We are not liable for indirect, incidental, or consequential damages
  • We are not liable for lost profits, lost data, or business interruption

Third-Party Services:

  • We use third-party platforms (GoHighLevel, etc.) to deliver Services
  • We are not responsible for failures, data breaches, or issues caused by third parties
  • You agree to review and comply with third-party terms of service

Intellectual Property:

  • We retain all rights to our automation templates, workflows, and proprietary processes
  • You receive a license to use the automation systems we build for you
  • You own all content you provide (business info, images, copy)

Confidentiality: We will not share your business information or client data with third parties except as required to provide Services. See our Privacy Policy for details.

Governing Law: These Terms are governed by the laws of the State of Illinois. Any disputes will be resolved in Illinois courts.

Modifications to Terms: We may update these Terms at any time. Material changes will be communicated via email. Continued use after changes constitutes acceptance.

Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and Thriving Automations LLC.
